1. Description of Service
Empty Leg Index is a market intelligence and information platform. We aggregate publicly available and licensed data about empty leg (repositioning) flights from third-party sources, score those listings against market reference data, and deliver alerts and analysis to registered users.
We are not an air carrier, air charter broker, travel agent, or travel agency.
We do not sell, charter, operate, arrange, or broker flights. We do not hold a Part 135 air carrier certificate, a Part 295 air charter broker registration, or any other FAA, DOT, or equivalent aviation operating authority. We do not act as an agent for any charter operator, aircraft owner, or aviation service provider.
The Service provides information only. Any decision to book, purchase, or engage with a flight opportunity identified through the Service is made entirely at your own discretion and risk, and any resulting transaction is solely between you and the relevant charter operator or third-party service provider.
2. No Broker or Agent Relationship
By using the Service, you acknowledge and agree that:
- No booking relationship exists. Empty Leg Index does not facilitate, arrange, negotiate, or participate in any flight booking or charter transaction. When you click a link to a charter operator's listing or website, you leave the Empty Leg Index platform and interact directly with that third party.
- No agency relationship exists. We are not the agent, representative, or partner of any charter operator, aircraft owner, FBO (Fixed Base Operator), ground transportation provider, or any other third-party service provider whose information may appear on the Service.
- No endorsement is implied. The inclusion of any operator, aircraft, route, airport, FBO, or third-party service on the Service does not constitute an endorsement, recommendation, or guarantee of quality, safety, reliability, or suitability. Market ratings and scores are informational assessments based on publicly available data and proprietary algorithms; they are not endorsements or recommendations to book.
- No flight liability. We have no liability whatsoever for the operation, safety, quality, punctuality, cancellation, modification, or any other aspect of any flight, charter, or aviation service you may book after discovering it through the Service.
3. Information Accuracy and Limitations
Data sources. The information displayed on the Service — including but not limited to empty leg listings, pricing, aircraft specifications, airport data, operator details, safety ratings, weather information, and market scores — is aggregated from third-party sources. While we make reasonable efforts to ensure accuracy, we do not independently verify every data point, and we cannot guarantee that any information on the Service is accurate, complete, current, or reliable.
Pricing and availability. Empty leg listings, pricing, and availability are controlled entirely by the charter operators who publish them. Listings may be inaccurate, outdated, already booked, modified, or cancelled at any time without notice to us or to you. The price displayed on the Service may differ from the price offered by the operator at the time of your inquiry or booking.
Market ratings and scores. Our market ratings (such as “Exceptional Value,” “Strong Value,” “Solid Value,” and “Market Rate”) are generated by proprietary algorithms based on reference data including estimated charter rates, seasonal adjustments, and event-driven demand factors. These ratings are informational tools designed to provide context — they are not financial advice, investment recommendations, or guarantees of value.
Aircraft and airport data. Aircraft specifications, cabin amenities, airport profiles, FBO information, pet policies, weather data, safety ratings, and other supplementary information are compiled from publicly available sources, government databases, and third-party data providers. This information may be outdated, incomplete, or inaccurate. You should independently verify all material information — particularly safety-critical information — before making travel decisions.
Safety ratings. References to ARGUS, Wyvern, IS-BAO, or any other third-party safety rating system are provided for informational purposes only. We do not conduct our own safety audits or assessments. The presence or absence of a safety rating on the Service should not be your sole basis for evaluating the safety of any operator.
Weather information. Weather data displayed on the Service is sourced from government and third-party aviation weather services. This information is provided for general awareness only and is not a substitute for official pre-flight weather briefings obtained from FAA-approved sources.
4. User Accounts and Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to create an account. Each individual may maintain only one account.
5. Subscription and Payment Terms
The Service offers a free tier with limited features and paid subscription tiers with additional features. Paid subscriptions are billed on a monthly recurring basis through our payment processor, Stripe. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features through the end of your current billing period. No refunds will be issued for partial billing periods.
We reserve the right to change subscription pricing at any time. We will provide at least 30 days' notice of any price increase. All payments are processed by Stripe, Inc. We do not store your credit card number or payment details on our servers.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) systematically scrape, extract, copy, reproduce, or redistribute data from the Service without prior written consent; (c) attempt to gain unauthorized access to any part of the Service; (d) use the Service to create a competing product or service; (e) resell, sublicense, or commercially exploit any data or features without prior written consent; (f) interfere with or disrupt the integrity or performance of the Service; (g) impersonate any person or entity; (h) use the Service in any manner that could damage or overburden our servers or networks.
7. Intellectual Property
The Service, including its design, text, graphics, logos, algorithms, scoring methodology, market ratings, data compilations, reports, and software, is owned by Empty Leg Index and is protected by copyright, trademark, and other intellectual property laws. Certain information displayed on the Service originates from third-party sources and remains the property of its respective owners.
8. Third-Party Links and Services
The Service may contain links to third-party websites, including charter operator booking pages, ground transportation services, and other aviation-related resources. We have no control over, and assume no responsibility for, the content, privacy policies, practices, availability, pricing, or performance of any third-party websites or services. Any transaction you enter into with a third party is solely between you and that third party. Some links on the Service may be affiliate links, meaning we may receive a commission or referral fee if you make a purchase through those links.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement; any warranty that the Service will be uninterrupted, timely, secure, or error-free; any warranty regarding the accuracy, reliability, or completeness of any information provided through the Service; and any warranty regarding the quality, safety, or availability of any flight or third-party service discovered through the Service.
You use the Service and rely on any information provided through the Service entirely at your own risk.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Empty Leg Index, its officers, directors, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes but is not limited to: damages arising from your use of or inability to use the Service; any information, content, market ratings, or scores provided through the Service; any transaction or relationship between you and any third party; any flight cancellation, delay, modification, safety incident, or other event related to a flight discovered through the Service; any unauthorized access to your account or data; and any interruption or cessation of the Service.
Our total aggregate liability to you for all claims shall not exceed the greater of (i) the total subscription fees paid by you during the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100.00).
11. Indemnification
You agree to indemnify, defend, and hold harmless Empty Leg Index, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to your use of the Service, your violation of these Terms, your violation of any applicable law, any transaction between you and any third party, and any content you submit through the Service.
12. Dispute Resolution and Arbitration
Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. If the dispute is not resolved informally within 30 days, you and we agree that any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
Class action waiver: You and we each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, available at emptylegindex.com/privacy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
15. Modifications
We reserve the right to modify, suspend, or discontinue the Service at any time. We may revise these Terms at any time by posting an updated version on the Site. Material changes will be communicated through the Service or by email.
16. Termination
You may terminate your account at any time. We may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to access the Service ceases immediately. Sections of these Terms that by their nature should survive termination shall survive.
17. General Provisions
These Terms constitute the entire agreement between you and us. If any provision is held unenforceable, the remaining provisions continue in full force. Our failure to enforce any right shall not constitute a waiver. You may not assign your rights without our prior written consent.

References to third-party safety rating systems (such as ARGUS, Wyvern, and IS-BAO) are provided for informational context only and do not constitute our own safety assessment.
You are solely responsible for evaluating the safety and suitability of any flight or charter service you choose to book.
We strongly recommend that you verify the operator holds a valid FAA Part 135 air carrier certificate, confirm the operator's current safety ratings directly with ARGUS, Wyvern, or IS-BAO, request pre-flight safety documentation, confirm that the aircraft is appropriately maintained and insured, and consult with a qualified aviation professional if you have questions about the safety of a planned flight.
